The Privacy and Consent Document for Real Estate in BC was introduced as part of the Real Estate Services Act changes in June 2018. This document replaces sections of the previously used Working with a Realtor document by the BC real estate industry.

We are required to have all of our Privacy and Consent Documents on hand when representing Buyers or Sellers. Any information we request is solely for the purpose of assisting the client in the real estate transaction. Apart from those mentioned in the situations below, we do not share this information with anyone.

Realtors, brokerages, and real estate boards must collect, use, and disclose some of your personal information in the course of their work on your behalf when you sell, buy, or lease real estate. Before doing so, your agent must provide you with a privacy notice that explains how they handle information. They must also obtain your written permission before using or disclosing your personal information.
What is the purpose of collecting, using, and disclosing my personal information?
Personal information about you may be collected, used, and disclosed for any of the following reasons:
To allow real estate board members to appraise your property.
To list and market your property on the Multiple Listing Service (MLS).
To promote your property via print and electronic media.
To assist you in finding a suitable property to buy or lease.
Government departments and agencies to facilitate real estate transactions).
To enable boards and their members to compile sales, property price, and lease rate statistics and conduct comparative market analyses. Your property’s information will be kept in the MLS system indefinitely.
Cooperating with real estate boards and regulatory bodies to enforce codes of professional conduct and ethics for Realtors.
to comply with legal requirements and act in accordance with legal authorizations
What methods are used to collect my personal information?
The majority of your personal information will be collected by your Realtor through the various documents you fill out or provide to them, as well as through discussions with you.
Some data may be obtained from secondary sources, such as financial institutions, government agencies, and mortgage brokers.
Who has access to my personal information?
Your personal information may be disclosed or made available to the following parties when you buy, sell, or lease real estate in British Columbia:
real estate boards, their employees, and their members
Departments and agencies of the government
financial establishments
lawyers and other service providers
the Real Estate Association of British Columbia
British Columbia Real Estate Council
Real Estate Association of Canada
members of the general public
All of these entities will not always have access to all of your information.
